HUKUM ABORSI AKIBAT PERKOSAAN (STUDI PEMIKIRAN YUSUF AL-QARDHAWI)

Abstract


This article is titled "Abortion Law Due to Rape (A Comparative Study of Yusuf Al-Qaradawi's Views)." The research aims to understand abortion from a medical perspective, Islamic perspective, the definition of rape, Yusuf Al-Qaradawi's biography, and his views on the law of abortion resulting from rape. The study employs library research, utilizing literature such as books, notes, or research reports. After analyzing the data, the research concludes that Yusuf Al-Qaradawi allows abortion when there is a stronger excuse, clearer permission, and it is closer to leniency if performed before forty days of pregnancy. Regarding the legality of using abortion-inducing drugs, Al-Qaradawi believes it is permissible "if the reason for abortion is stronger, the permission is clearer, and the abortion is done before the 40th day of pregnancy".
